The Supreme Court of Nigeria has delivered a unanimous judgment in the long-standing leadership dispute within the African Democratic Congress (ADC), marking a significant but not final development in the internal party crisis.

In its ruling, the apex court recognized Senator David Mark and his team as the legitimate leadership of the party at this stage of the proceedings. However, the Court clarified that the substantive issues surrounding the dispute are to be returned to the Federal High Court for further determination.
Earlier in the proceedings, the Supreme Court also set aside an order that sought to maintain status quo ante bellum, effectively lifting the restriction that had preserved the party’s previous internal arrangement. This move signaled the Court’s unwillingness to freeze the situation pending the final resolution of the matter.


In addition, the preliminary objection raised by the opposing faction was dismissed, allowing the case to proceed on its substantive merits rather than being struck out on technical grounds.
What the ruling means
In practical terms, the judgment gives Senator David Mark’s faction temporary legal advantage at the Supreme Court level, as their leadership is currently recognized within the context of the ruling. It also clears the procedural hurdle that could have stalled the case entirely.
However, the dispute is far from concluded. With key issues referred back to the Federal High Court, the final determination of the party’s leadership structure remains open and will depend on subsequent judicial proceedings.
Political observers note that while the ruling strengthens one side’s position for now, it does not fully resolve the deep-seated internal contest within the ADC.
The final outcome, therefore, will be shaped by further hearings at the Federal High Court.
